Accused rapist might face judicial charges

Robert Martucci, an NIU student arrested by DeKalb Police and charged with sexual assault, might face university charges.

Martucci, 21, 906 Kimberly Drive #4, posted $2,500 bond and is scheduled to appear in court Feb. 15 for charges of sexual assault and unlawful restraint, said DeKalb Police Lt. Richard Moudy.

NIU Judicial Office Director Larry Bolles said he expects the victim to file a complaint today. “If a complaint is filed, the university will pursue the charges,” Bolles said.

Martucci would be contacted and given due process by the judicial office, he said. The case could lead anywhere from a verdict of “not guilty to an expulsion,” he added.

Michelle Emmett, director of Univerisity Programming and Activities, said she incorrectly stated Martucci was deactivated from the Delta Upsilon fraternity because he did not pay his bills. Martucci was deactivated because he refused to follow bylaws.

Because the fraternity is not involved in the case, the UP&A will not get involved, she said.

Emmett said Martucci was “removed by the local alumni group because he would not live in the house,” according to the National Delta Upsilon Headquarters.

Refusing to live in a fraternity house is against the fraternity’s bylaws and “is not unusual,” Emmett said.

This information was “confirmed verbally” by the national headquarters and the UP&A is awaiting a written confirmation, Emmett said.
