Student arrested for assault

NIU student Robert J. Martucci was arrested Tuesday by DeKalb Police and charged with criminal sexual assault.

Martucci, 21, an NIU senior economics major was arrested Tuesday morning by DeKalb Police and charged with criminal sexual assault and unlawful restraint according to DeKalb Police Lt. Richard Moudy. Martucci was identified by the victim and taken to the DeKalb County Jail.

The alleged incident occurred about 1:45 a.m. on Kimberly Drive and Martucci was arrested at 9:30 a.m., Moudy said.

The victim reported the assault to both the University Police and DeKalb Police departments, but Greek Row is not in the UPs’ jurisdiction said UP Lt. Ron Williams.

According to DeKalb police, Martucci lived at 1114 Blackhawk Road, the Delta Upsilon fraternity house. However, Michelle Emmett, director of University Programming and Activities, said she was told by DU President John Harzich that Martucci was deactivated from the fraternity house in the spring of 1989.

Harzich said, “He (Martucci) is no longer a member” and declined further comment.

UP&A is awaiting proof that Martucci was evicted from the fraternity house because he failed to pay his bills, Emmett said.

The UP&A would only punish the fraternity if it played an active part in the alleged incident or “set the tone,” such as a party with alcohol, Emmett said.

Emmitt said DUs did not hold a fraternity function on Monday night, the fraternity was in dry rush, in which no alcohol was allowed at the house, and Martucci was not in the house on the morning of the incident.

Until the facts are sorted, UP&A cannot give any estimated punishments for the incident, Emmett said.

If the fraternity is not involved in the incident, the NIU Judicial Office will handle the punishment for the incident, Emmett said. Judicial Office Director Larry Bolles could not be reached for comment.
