Center receivership dismissed

The city-petitioned receivership for the DeKalb Center, 1100 W. Lincoln Hwy., has been dismissed on request by the city, student legal services and center owners.

DeKalb city officials, NIU Students’ Legal Assistance and the owners of the center, Tony and Joseph Navilio, agreed to a dismissal of the city-petitioned receivership, said DeKalb City Attorney Ron Matekaitis.

“We’re really pleased with the actions of the city officials,” said NIU Legal Assistance Director Don Henderson. The management of the apartment complex also showed commitment by returning the center to “livable conditions,” Henderson said.

“I’m not pleased that we had to go to the extent we did,” said Bill Nicklas, director of DeKalb Building and Community Services, but “I’m happy for the tenants who can now enjoy the decent living conditions.” Seventy percent of the DeKalb Center residents are students.

City officials are “very pleased with the progress made” at the center, said DeKalb City Attorney Ron Matekaitis. Officials are confident the living conditions of the tenants have improved, Matekaitis said.

The dismissed receivership would have appointed an independent property manager to repair the 104 structure code violations at the center.

At an Oct. 13 court hearing, the owners of the center were given a week to repair 98 of the violations and finished all but “three or four” which deal mainly with “paperwork,” Matekaitis said.

The remaining six violations include roof repairs, damage to a brick facade and improper sewage draining and are scheduled for completion by August of 1990, he said.

The roof and brick facade are scheduled for completion Dec. 31 and the cross connection sewer will be completed by August 1, Matekaitis said.

The tenants of the center received a rent abatement, which allowed for one free month of rent, Henderson said. The rent payment will be subtracted from the remaining monthly payments, he said.
