Supervision set for frat. member

A member of the Sigma Pi fraternity house was found guilty of disorderly conduct that led to a brawl between members of his fraternity and members of the Sigma Phi Epsilon fraternity house May 12.

Sig Pi member Dino Agbayani was found guilty and received a sentence of court supervision, said an employee of the DeKalb County Circuit Clerk’s office.

The circuit clerk’s report stated, “The defendant did, without legal justification, intentionally cause bodily harm to (Sig Ep member) Thomas J. Caruso, in that he struck Thomas Caruso in the face with his fist.”

Agbayani received 12 months of court supervision, a fine of $150 and 40 hours of community service, the report stated.

On July 5, 1989 a court will determine if Agbayani has successfully complied with the conditions of his supervision.

If not, the court will enter a judgment accordingly, the report stated.

Neither Agbayani nor Caruso could be reached for comment Monday.

Sig Pi Chapter President Jerry Nelligan said Agbayani received intramural probation from their national charter.

He said Agbayani cannot participate in any intramural activities for one semester.

Caruso filed charges against Agbayani May 16.

Jeff Cufaude, adviser for University Programming and Activities, said the fight between Agbayani and Caruso occurred at The Jungle, 1027 Hillcrest Drive.

Cufaude is Sig Pi’s adviser and was at the time of the fight. He said his office of adviser had no effect on the sanctions imposed on Sig Pi’s after the fight.

After the fight at The Jungle, Caruso went back to the Sig Ep house, instead of calling the police, Emmett said.

Several Sig Eps then proceeded to the Sig Pi house, she said.

Later that night, a fight occurred between the two fraternities at the Sig Pi house. Nelligan said about 40 Sig Eps carrying weapons barged into the Sig Pi house and began hitting people.

Caruso’s mother, Vhilomena Caruso, said her son was arrested for illegal trespassing, but she said her son was not at Sig Pi’s at the time of the brawl.

However, Emmett said members of both houses claimed Tom Caruso was at Sig Pi’s during the fight.

She said Sig Eps members claimed he was outside the house, while some Sig Pi’s claimed he was inside the house.
