Attorneys in process of finalizing Van Arsdale plea agreement

Phil Montgomery, assistant state’s attorney for DeKalb County, requested more time at a hearing Wednesday to determine the amount of restitution for one of the former NIU students charged with the April 5 shooting of NIU linebacker Devon Butler.

Richard Van Arsdale III, 21, is charged with two counts of attempted murder, two counts of aggravated battery with a firearm, aggravated discharge of a firearm, armed violence and unlawful delivery of cannabis.

Attorneys are still in the process of finalizing the terms of a potential plea agreement, said DeKalb County State’s attorney Clay Campbell.

According to a Sept. 23 Northern Star article, “Police have said Van Arsdale is believed to be the driver of the getaway vehicle involved in the shooting, while [Mark] Orozco is believed to be the shooter.”
