Assault suspect apprehended, not arrested

The University Police continue to refuse official comment on a Monday morning rape that occurred at Neptune Hall.
The UPs also declined to confirm or deny information obtained by The Northern Star.
The only official information about the incident was made available through the public portion of the UP radio dispatch records.
The records state a sexual assault suspect was “caught” in the lobby of Neptune North soon after the assault allegedly occurred. The statement also matches information obtained from a reliable source close to the incident.
This information was neither confirmed nor denied by the UPs. However, Kathy Guimond of the Sexual Assault Response Team said the people responsible for the information on the reports might not have the authority to give out information because they might not be sworn UP officers.
Because “custody implies arrest” the UPs denied ever having a suspect in custody, Guimond said.
According to the source, the rape suspect was a visitor to NIU and is a member of the Omega Phi Psi fraternity on another campus. The police refused to release the name of the suspect because there was no warrant issued for his arrest. Guimond refused to confirm or deny the information.
The alleged assailant was then released because the victim, who had been taken for medical attention to a hospital, did not sign a complaint, the source said. Guimond refused to confirm or deny any of the information.
UP Capt. James Webster was unavailable for comment.
