Hearing postponed

A preliminary hearing for a Dixon man facing multiple drug charges in DeKalb was postponed because his attorney requested that his $1 million dollar bond be lowered.

The attorney for Richard Janacek, 38, 616 S. Ottawa St., Dixon, filed a motion last week to reduce Janacek’s bond. The bond reduction would release Janacek on his own recognizance in lieu of bail.

Janacek’s preliminary hearing was scheduled for April 13.

Janacek was arrested and charged by DeKalb Police April 2 with possession with the intent to deliver more than 15 grams of a controlled substance.

The DeKalb County State’s Attorney’s Office later filed an additional charge of possession with the intent to deliver against Janacek after laboratory tests at the Illinois State Police Crime Lab in Rockford showed that a white powder substance in Janacek’s possession at the time of his arrest was cocaine. More than 100 grams of the substance were confiscated when Janacek was arrested.

The drugs have a street value of between $10,000 and $14,000, depending on how the substance is packaged and sold.

Janacek was arrested after DeKalb Police responded to a disorderly person call at Amber Manor Apartments, 807 Ridge Drive. Police reports state a female wanted to press harassment charges against Janacek, who had left the apartment.

Police arrested Janacek upon finding him hiding in his car at the apartment complex. The woman was granted an order of protection because she alleges that Janacek beat her on a previous occasion.

Bail is intended to assure the defendant will appear in court through holding the defendant’s bond. Bond is 10 percent of the defendant’s issued bail. Recognizance bond is a promise to appear in court without posting money.

To be released on a recognizance bond, the court evaluates the circumstances of the offense the defendant is charged with, the defendant’s family ties, employment, financial resources, character and mental condition, how long the defendant has resided in the community, prior convictions and record of appearance at court proceedings.

At the time of his arrest, Janacek was free on an $18,000 appeal bond for an August 21 conviction of conspiracy to deliver a controlled substance. Janacek is appealing an October 10 sentence of 30 months probation with four weekends in jail, resulting from the August conviction, to the Second Appellate Court in Elgin.

If convicted, Janacek faces a six- to 30-year prison sentence and a fine of up to $500,000.
