Board of Trustees votes to approve $1 million settlement in Grady lawsuit

The Board of Trustees voted to end litigation in the lawsuit brought before NIU by Don Grady, former NIU police chief, at a Thursday Board of Trustees meeting.
In 2013, Grady was fired because of the NIU Police Department’s alleged mishandling of a criminal sexual assault case involving Andrew Rifkin, former NIU police officer, and an undergraduate student, according to the opinion of Judge Harry Leinenweber in a March 10 Northern Star article.
After a Nov. 21 mediation, the two sides reached an agreement to settle because of “the financial cost of a two week trial, the inconvenience to the University’s employees who were also defendants in the case, and the disruption of University operations for University employees to participate in the trial,” according to the Nov. 15 Board of Trustees report.
The settlement says $1,025,000 will be paid to Grady and his attorneys; One million dollars will be paid by NIU’s insurer and $25,000 will be paid by the University, according to the Nov. 15 Board of Trustees report.
As a final measure of the settlement, NIU will withdraw its termination of Grady to allow him to be reinstated followed immediately by his voluntary resignation, according to the Nov. 15 Board of Trustees report.
With the vote to approve a settlement, the two sides will now file a joint stipulation to dismiss the litigation and remove the case from the court’s docket.
