Motion to dismiss Schmidt indictment deferred
April 2, 2012
At a Monday status hearing, a pre-trial motion to dismiss the indictment for the Sycamore woman charged in the February 2011 accident that killed an NIU student and her boyfriend, was deferred to a later date.
An indictment is a formal charge or accusation of a crime.
Patricia Schmidt, 47, is charged with two counts of reckless homicide, two counts of aggravated reckless driving and 13 counts of aggravated driving under the influence.
The accident occurred Feb. 21, 2011. Schmidt was driving a Ford pickup truck south bound on Sycamore Road when she allegedly drove through a red light and collided with a Pontiac heading east bound on Plank Road. The Pontiac was driven by Timothy T. Getzelman, 21, of Sycamore, and NIU student Alexis “Lexi” Weber, 21, of Maple Park, who was riding as a passenger in Getzelman’s vehicle.
Getzelman was pronounced dead at about 6:12 p.m. and Weber was taken to Kishwaukee Community Hospital where she was pronounced dead.
Schmidt’s next scheduled court date is May 18.
