A DeKalb woman has been charged with attempted first-degree murder after authorities say she tried to smother her four-month-old son.
During a hearing June 16 for Kristen Shaw, 26, Circuit Judge Robbin Stuckert set bond at $500,000, according to court documents. Shaw is required to pay 10 percent, or $50,000 to be released from jail.
First-degree murder is a Class X felony which, upon conviction, carries a penalty of between six and 30 years in a state penitentiary and a fine of up to $25,000. Shaw is also charged with aggravated domestic battery, a Class 2 felony. Class 2 felonies carry penalties upon conviction between three and seven years in a state penitentiary and a fine of up to $25,000.
According to court documents, Shaw allegedly attempted to smother her baby with a pillow on June 15 following an argument with her boyfriend, who is also the child’s father.
Gary Dumdie, chief deputy with the DeKalb County Sheriff’s office, said Shaw and her boyfriend were arguing around 1:30 a.m. when the baby started crying. Shaw went into the baby’s room. When the crying stopped, Shaw’s boyfriend went in to the room to check on the baby.
Dumdie said the child’s father found Shaw holding a pillow over the baby’s nose and mouth. He was able to remove the pillow Shaw was holding. Shaw then grabbed another pillow and put it over the baby’s nose and mouth, he said.
Dumdie said the father remained with the baby until Shaw left for work, at which point he contacted police.
According to court documents, in video-taped statement Shaw said she placed the pillow over her baby’s face twice but did not intend to hurt him. Shaw could not provide a reason why she used the pillow.
The Illinois Department of Child and Family Services (DCFS) is also involved in the case, Dumdie said.
According to the DCFS website , the Department promotes the well-being and protection of children and works with communities to promote safe and appropriate family life.
“The DCFS is investigating an allegation of abuse by the mother in this family,” said DCFS spokesman Kendall Marlowe. “There have been no prior investigations of this family and there are no other children in the home.”
Shaw is scheduled to appear in court on June 29.
