Arraignment date set for Orozco

One of the former NIU students charged in connection with the April 5 shooting of Devon Butler at 1009 Aspen Court will appear in court later this month for arraignment.

Mark Orozco, 24, appeared in court Monday for a status hearing. According to court documents, subpoenaed medical records were given to the prosecution during the hearing.

Phil Montgomery, DeKalb Assistant State’s Attorney, said the prosecution subpoenaed Butler’s medical records from Kishwaukee Community Hospital, 1 Kish Hospital Drive in DeKalb, and OSF Saint Anthony Medical Center, 5666 E. State Street in Rockford, and are forwarding them to Orozco’s defense attorney.

Orozco is scheduled to appear for his arraignment on June 28. Montgomery said Orozco will be advised of the minimum and maximum penalties for the charges at that time. Orozco’s defense attorney may also enter pre-trial motions during the arraignment.

Montgomery said Orozco will plead not guilty.

Orozco was incited on nine counts on May 24, including three counts of attempted first-degree murder, two counts of armed violence and one count of aggravated battery with a firearm. Co-defendant, former NIU student Richard Van Arsdale III, was indicted on seven counts.

Van Arsdale is scheduled to appear in court on June 6.
