Suspects’ bond set at $1 million in Butler shooting

Bond was set at $1 million each Thursday morning for the two NIU students charged with shooting football linebacker Devon Butler.
Mark Orozco, 24, and Richard Van Arsdale III, 20, appeared in court via closed-circuit television Thursday morning and have each been charged with one count of attempted first-degree murder and one count of aggravated battery with a firearm, both punishable by up to 30 years in prison.
Orozco and Van Arsdale have also been charged with one count of aggravated discharge of a firearm, punishable by up to 15 years in prison, and one count of the unlawful delivery of cannabis, punishable by up to three years in prison.
Orozco and Van Arsdale would have to pay 10 percent, or $100,000, of their bond in order to be released.
Van Arsdale said he did not know he was being charged with the unlawful delivery of cannabis.
“I was unaware of that, but I understand,” Van Arsdale said.
Phil Montgomery, DeKalb County Assistant State’s Attorney, said police executed two search warrants on Orozco’s place of residence and automobile. Police found marijuana plants, the weapon allegedly used in the shooting, a drug ledger and hidden cash equalling about $800 in Orozco’s residence and three bullet casings in Orozco’s automobile, Montgomery said.
Orozco and Van Arsdale were arrested in connection with the shooting at 1009 Aspen Court late Tuesday night. Police said the shooting was a result of a bad drug transaction.
Butler, middle linebacker for the NIU football team, was shot in the upper right side of his back. Butler was in the building visiting friends and not involved in the earlier drug transaction, police said. Montgomery said Orozco is believed to be the shooter, and Van Arsdale was driving the automobile.
Orozco’s next court date is scheduled for April 21 and Van Arsdale’s court date is set for May 2.
