O’Leary’s fights for smoking ban exemption

DeKALB | The DeKalb smoking ban has taken a toll on O’Leary’s Pub, 260 East Lincoln Highway, and the establishment is looking for a way change their flow of business.

Owner Mel Witmer said he feels the ban has given an advantage to other businesses.

“Our gripe is that we feel they’ve given a competitive edge to the competition,” said Witmer.

Witmer has reported significant business loss from the ban, including a 27 percent decrease in liquor sales and the loss of a $1,800 wedding party.

Legal Council for Whitmer and O’Leary’s, Thomas Doherty, is hoping to resolve this problem with the city.

“We want to arrange a meeting and work it out,” said Doherty. “The last thing we want is litigation.”

Doherty hopes the city can amend the smoking ban.

DeKalb City Attorney Norma Guess said it is possible to change the ordinance.

“They can request the city manager to put it on the agenda,” said Guess.
