Trial for NI Towing owner postponed due to witness

A jury trial for Michael Fitzgerald, NI Towing owner who is charged with unlawful towing practices, has been postponed to Nov. 2 because witnesses for the city of DeKalb were unavailable.

Fitzgerald pleaded not guilty to six charges brought against him by DeKalb City Attorney Ron Matekaitis.

Court records state Fitzgerald is charged with towing a vehicle in an authorized parking space and two counts of towing a vehicle from private property without the property owner’s written permission.

Fitzgerald also has been charged with denial of immediate release of a towed vehicle after the owner demanded release and payment was made. The charge includes failure to provide a written statement to inform the vehicle owner of his rights and means of recourse and failure to inform the owner of the city’s role and responsibilty prior to the acceptance of towing fees and release of vehicle, court records state.

The city also charges Fitzgerald with failure to post the name, business address and phone number of the city manager or his designee to which inquiries or complaints might be sent.

The trial is rescheduled for 10 a.m on Nov. 2 at the DeKalb County Courthouse in Sycamore, Matekaitis said.
