Court to hear properly suit

A pre-trial will be held today in the DeKalb County Courthouse for a Board of Regents’ eminent domain lawsuit filed last fall.

The lawsuit was filed Oct. 14, 1987, on NIU’s behalf to determine how much land south of the NIU campus the university can obtain from the current landowners. The property involved in the lawsuit is located between Lincoln Terrace and Lincoln Highway, and between Carroll Avenue and Normal Road.

The pre-trial will be heard at 11:30 a.m. before Judge Rex Melinger.

Gary Cordes, attorney for the residents, said the pre-trial was originally scheduled for Oct. 20 but was postponed due to an illness. He said that in the past week the two parties have discussed the case, “but no settlements have been reached.

“There won’t be anything solved tomorrw, but I think we’re getting close,” Cordes said.

In a previous interview, Cordes said both parties involved “would like to settle out of court if they could.”

Michael Funkey, attorney for the Regents, could not be reached for comment Wednesday.
