Rink’s charges dropped

Forgery charges against former NIU marketing Professor David Rink were dropped officially yesterday, but his appeal to regain employment is in the working.

Richard Larson, DeKalb County associate circuit judge, dismissed charges because there was not enough legal evidence against him.

State’s Attorney Phil DiMarzio said a decision was made in December to quash a search warrant which allowed Elgin Police to confiscate evidence from Rink’s home. Thus, the evidence was suppressed.

DiMarzio said after examining the law in relation to the search warrant, an appeal would not be appropriate.

He said DeKalb County Judge John Leifheit ruled information was withheld from the Kane County judge who issued the warrant. “If the complaint was drawn differently, I think a different result would have been obtained,” he said.

DiMarzio said he regrets the Elgin Police not contacting his office when obtaining the warrant.

William Brady, Rink’s attorney, said although the charges were dropped, Rink still will appeal his dismissal from NIU. Rink was dismissed after not complying with NIU policy which states a professor cannot work for another institution without seeking permission from NIU.

The appeal is scheduled to reach the Board of Regents in March. “It would be premature,” to say if Rink will take other action, since the appeal is still in process, he said.
