Sex assault case closed after probe

DeKalb Police have closed the case of a criminal sexual assault which occurred Nov. 23 after determining the facts of the case did not warrant a criminal arrest.
In an official statement, police said all of the information they received from their investigation was presented to the DeKalb County State’s Attorney’s office.
DeKalb County State’s Attorney Philip DiMarzio said after examining the evidence there was no basis for a criminal charge.
“The statute required an additional element (of evidence) we did not have,” DiMarzio said.
The assault, which occurred in a DeKalb motel, involved a 21-year-old non-resident of DeKalb County. Police said the alledged suspect was an acquaintance of the victim.
DeKalb Police Detective William Feithen said there is no indication this incident has any connection with any other assault incidents that have occurred in DeKalb.
Since Oct. 1, three rapes reportedly have occurred in DeKalb and two sexual assaults in NIU residence halls. Police said only one of the incidents involved a man with a ski mask.
DeKalb Police and University Police currently are investigating the incidents.
