16 women added to Bogenberger lawsuit

A Cook County judge may decide to allow 16 women to the Bogenberger family’s lawsuit on Friday.

The family is attempting to add the women to the family’s lawsuit against Pi Kappa Alpha and other entities, according to Peter Caldarci, the Bogenberger family’s attorney.

Caldarci said the judge did not approve a motion to add the women on April 24 because of a technicality.

The women’s names were obtained from police statements released last month in regard to the those present the night of David Bogenberger’s death on Nov. 2.

Caldarci said police statements indicated the women were co-responsible for the event by allowing the hazing acts and underage drinking to continue.

The police statements were obtained from the NIU Police Department, the DeKalb Police Department and the DeKalb County State’s Attorney’s office.

“The family wants to make a point that everyone present the night is co-responsible for the event, both men and women,” Caldarci said. “It’s adamant that more people, especially college kids, are made aware of these kinds of deaths. They need to know that just being present makes them accountable.”

Caldarci cited the National Institute on Alcohol Abuse and Alcoholism, which reports that more than 1,800 college students aged the 18 to 24 die each year from alcohol-related unintentional injuries.

Caldarci said the 16 women had no group affiliation to any specific sorority house.

The lawsuit is asking for more than $100,000 in damages from the national Pi Kappa Alpha fraternity and its Eta Nu chapter at NIU, along with chapter officers, event organizers and party participants.
