Prosecution rests case against former NIU student charged with shooting

The prosecution in the case against one of the men charged with the April 5 shooting at 1009 Aspen Court has no further evidence to provide to the defense, said Phil Montgomery, DeKalb County Assistant State’s Attorney, at a hearing Thursday.

An attorney for former NIU student Mark Orozco, 24, said the defense is currently continuing to review evidence already provided by the state.

Orozco, along with co-defendant and former NIU student Richard Van Arsdale III, 21, have been charged with attempted first-degree murder, armed violence and aggravated battery with a firearm in connection with the April 5 shooting, during which NIU linebacker Devon Butler was shot. Orozco is also charged with aggravated discharge of a firearm, because police have said they believe he was the shooter and Van Arsdale was driving the getaway vehicle during the incident.

Orozco’s next scheduled court date is Dec. 22.
