Former NIU students Mark Orozco, 24, and Richard Van Arsdale III, 20, were indicted by a grand jury for their alleged roles in the April 5 shooting of NIU linebacker Devon Butler Tuesday.

According to court documents, Orozco was indicted on a total of nine counts, including three counts of attempted first-degree murder, two counts of armed violence, as well as one count of aggravated battery with a firearm, all of which are Class X felonies.

Orozco was also indicted on one count of the unlawful delivery of cannabis, a Class 4 felony and two counts of aggravated discharge of a firearm, a Class 1 felony.

Van Arsdale was indicted on seven counts; two counts of attempted first-degree murder, two counts of aggravated discharge of a firearm, one count of armed violence and one count of the unlawful delivery of cannabis.

DeKalb Police believe the shooting at 1009 Aspen Court was in response to a bad drug deal that occurred earlier in the day on April 5.

Police have said they believe Orozco fired the shots, one of which hit Butler in the upper right side of his back. Van Arsdale is believed to be the driver of the vehicle.

Police have said Butler was not involved in the earlier drug deal.
