One of the men charged in the April 5 shooting of NIU linebacker Devon Butler appeared in court Wednesday for a status hearing.

Former NIU student Mark Orozco is charged with attempted murder, aggravated battery with a firearm, aggravated discharge of a firearm and the unlawful delivery of cannabis.

Orozco’s attorney filed a Substitution of Attorney. According to the DeKalb Circuit Clerk, Attorney Todd Cohen has taken over as Orozco’s defense attorney.

Cohen also filed a motion for discovery. Donald Henderson, director of Student Legal Assistance, said a motion for discovery is a motion made for any information pertaining to the case that the defense could use at trial.

DeKalb Police have said they believe Orozco was the one who allegedly fired four shots into the apartment that Butler was visiting and that former NIU student Richard Van Arsdale III was the driver. Van Arsdale is also charged in the shooting and has a status hearing scheduled for Monday morning.

Orozco’s next court appearance is scheduled for May 9.

Butler was recently released from OSF St. Anthony Medical Center in Rockford.
