Crystal Lake man indicted on charge of drug-induced homicide

A DeKalb County grand jury indicted a Crystal Lake man Thursday on one count of drug-induced homicide after allegedly selling heroin to a Kirkland man who later died of an overdose.
Daniel Schak, 21, of Crystal Lake, was arrested after allegedly selling the drug while in Chicago to Bradley Koch, 18, who died Feb. 15 at Kishwaukee Community Hospital. Schak is being held on a $555,000 bond at DeKalb County Jail.
This is the first such charge in DeKalb County since “Kelley’s Law” came into effect in 2002, said Ron Matekaitis, DeKalb County state’s attorney.
DeKalb County Sheriff’s Police arrested Schak on Feb. 16 for the sale of heroin, Matekaitis said. The charge of drug-induced homicide was presented to the grand jury after further investigation.
Kelley’s Law is an Illinois law that expands the charge of drug-induced homicide to include the unlawful delivery of any controlled substance that results in an overdose death, according to the governor’s office.
Heroin activity only recently has become present in DeKalb County, Matekaitis said.
Drug-induced homicide is a Class X felony, and Schak could face up to 30 years in prison if convicted, said Clint Hull, first assistant state’s attorney. As of Friday, no other charges had been filed by the state’s attorney in connection with the case.
