Licensees face trouble
March 17, 2003
Three establishments in DeKalb are facing possible suspensions of their liquor licenses today.
Molly’s Eatery and Drinkery, 1022 W. Lincoln Highway, and El Burrito Mexicano, 402 E. Lincoln Highway, had charges filed against them on March 7.
According to the routing sheet, prepared by City Attorney Margo Ely, Molly’s advertised for an for an all-you-can-eat pizza buffet, including bottomless pop or beer for $5.99 which ran in the March 3 issue of the Northern Star.
The advertisement violated Chapter 38.30 of the Municipal Code, which states that no retail licensee or employee or agent of such licensee should sell or serve to any person an unlimited number of drinks during any set time period for a fixed price, except at private functions not open to the general public.
Ely said that kind of promotion isn’t acceptable because the city of DeKalb doesn’t want people to drink a lot of beer in a small amount of time.
The violation requires a fine or a suspension of the Class A license. Molly’s was unavailable for comment at press time.
El Burrito Mexicano has been involuntarily dissolved as a corporation according to the routing sheet prepared by Ely. They failed to show proof of a current corporation.
El Burrito Mexicano also has failed to pay its liquor license renewal fee, which is $825 and was due on Feb. 28, and the restaurant and bar taxes to the city for July through December 2002.
The establishment provided a certificate of liability insurance that expired on March 1 and failed to provide proof of insurance.
El Burrito Mexicano was unavailable for comment at press time.
Eduardo’s, 214 E. Lincoln Highway, also will appear before the liquor commission because of a Jan. 30 incident in which eight minors were let in without having to show identification with proof of age. Their Class A license could be suspended. Owners of Eduardo’s declined to comment on the case.
Eduardo’s hearing will take place at 4 p.m., Molly’s at 4:30 p.m. and El Burrito Mexicano’s at 4:45 p.m. All hearings will take place in Conference Room 200 at the DeKalb Municipal Building, 200 S. Fourth St.
