City attorney petetions to close Dungeon

Almost four months after The Dungeon opened, the city is looking to close it down.

“We received police reports and decided to pursue the case,” said City Attorney Margo Ely.

A petition was prepared by Ely to try to revoke the license for the teen club, located at 1025 W. Hillcrest Drive. The establishment received its license on Oct. 11.

The Dungeon is enlisted as a type B club, which means it’s restricted to people ages 18 and over.

The main problem that was in the petition regarding the club was the multiple numbers of disorderly crowds and outbreaks of violence.

According to the petition, there were several situations in which the club violated Chapter 32.08 of the municipal code.

She said law enforcement that took part in some of the situations at The Dungeon will be called to testify at the hearing. The Dungeon also will have the opportunity to defend its club and case.

Lt. Carl Leoni of the DeKalb Police Department said he was there during some of the incidents at the club, but declined to comment further since he will testify at the hearing.

Ely said the decision for the petition did not come out of nowhere.

“The timing is directly related to the incidents,” Ely said.

She said DeKalb officers have discussed The Dungeon’s problems with the owner, David Hana, but nothing came of it.

“They had plenty of opportunities, but they haven’t done anything,” Ely said.

During some of the events The Dungeon held, DeKalb police were there in case something happened. Ely said security should be something the management took care of.

This is the first time in recent history that Ely could remember the city trying to shut down a teen club.

Ely said the city has not heard of any reaction from the owners of The Dungeon.

The hearing will take place at 9:30 a.m. on March 7 in Conference Room 212 at the DeKalb Municipal Building, 200 S. Fourth St. Ely said it was not certain when a decision will be made.

Hana, the owner of The Dungeon, declined to comment.
