Court postpones Allgood assault case

A motion to present new information in the sexual assault case against Todd S. Allgood, a Sycamore resident and former NIU student, has been postponed.

All good originally was arrested on April 25 after police say he kidnapped and sexually assaulted a 21-year old NIU student.

The hearing, which was supposed to take place Wednesday, was requested by the DeKalb County State’s Attorney’s Office, which also was asking permission to present newly obtained information. Citing a sickness in the family, Allgood’s lawyer asked that the hearing be rescheduled, prosecutor Joe Pederson said.

The rescheduled status hearing is set for Oct. 19.

The evidence being presented was discovered by the DeKalb Police Department in late August. In it, DNA evidence links Allgood to two sexual assaults that occurred in Mundelein, about 75 miles northeast of DeKalb, more than 10 years ago.

Allgood had his bond revoked after the new evidence surfaced. He returned to county jail on Aug. 20 after he was deemed a public threat.

Allgood cannot be charged for the new evidence because when the crimes were committed the statute of limitations for sexual assaults in the state was only five years, DeKalb police Lt. Jim Kayes said. Instead, the state will use it as evidence in Allgood’s current case.

Police say the victim said Allgood abducted her at gunpoint while she was entering her car just east of the Mason Property Office, 120 N. Annie Glidden Road, and south of NIU parking lot 38/S. She reportedly was forced to drive Allgood to his home, where he sexually assaulted her. He then forced the victim to drive him to Gabel Hall where he exited her vehicle.

Similar stories were reported by Allgood’s victims in Mundelein, Kayes said.

Though he can’t be charged, Pederson says this still is information that’s important to the case. At the same time, Allgood’s lawyers are working to keep this information out of the trial.
