University Police on Wednesday arrested the victim of a stabbing that occurred April 19 at the Grant Towers South lobby.
Michael J. Malcolm, 19, of Park Forest was arrested on a warrant for aggravated battery in connection with the incident, interim UP chief Lt. John Hunter said. Malcolm, an NIU undecided major, allegedly was involved in a beating in the residence hall lobby before he was stabbed.
Police responded to the fight about 11 p.m. April 19. Officers and witnesses said it involved a spilled Fruit Works drink near the front-entrance automatic-teller machine.
During the investigation, UP Sgt. Todd Henert said that although Malcolm was stabbed, the circumstances didn’t necessarily mean the person who did the stabbing would be charged. Witnesses have said the student who stabbed Malcolm was not at fault.
“There are circumstances where a person can defend himself,” Henert said. “We found that he was justified in doing what he did. There was a considerable size disparity between Mr. Malcolm and the person he was allegedly battering. Size sure played a part in all of this.”
Malcolm was released from Kishwaukee Community Hospital the weekend of the stabbing. Hunter said he was taken Wednesday to the DeKalb County Jail, where he was expected to post $5,000 bond.
Aggravated battery is a Class 3 felony punishable by two to five years in prison or a fine of
