Rifkin’s attorney files notice of appearance

The attorney for the former NIU police officer charged with sexually assaulting a student filed a notice of appearance at a hearing Friday.

Clay Campbell, DeKalb County State’s Attorney, said the notice of appearance is a document stating attorney David Smolin, is appearing on behalf of Andrew Rifkin.

No motions were filed and no plea was set at Friday’s hearing, Campbell said.

Rifkin, 24, is charged with criminal sexual assault, a class 1 felony. If convicted, Rifkin could face up to 30 years in prison.

In a Nov. 2 Northern Star article, Victor Escarcida, DeKalb County Assistant State’s Attorney, said Rifkin is accused of committing an act of sexual penetration without the consent of the NIU student.

NIU Police said Rifkin and the victim had some sort of a relationship, and the incident occurred off campus. Rifkin is no longer employed by the university and is banned from campus, said Paul Palian, director of Media and Public Relations in the Nov. 2 Northern Star article.

Rifkin is next scheduled to appear in court Dec. 5 for a status hearing.
