Free speech versus war protests

By Ryan Strong | September 22, 2006

DeKALB | Located in the center of campus, the MLK Commons is an ideal area to hold university events, including speeches, political rallies, "nooner" concerts, art exhibits and displays for student organizations.

While NIU does not have a speech code, there is a "Policy Concerning Demonstrations" required by state law. According to the policy, individuals expressing free speech cannot inhibit the rights of others, and cannot disrupt the educational and business operations of the university.

The consequences range from receiving warnings to being arrested. Individuals violating the "Policy Concerning Demonstrations" will be referred to the office of judicial affairs for disciplinary action.

Student organizations recognized by the university and NIU departments and units that wish to reserve the MLK Commons are advised to contact the office of Student Involvement & Leadership Development to arrange a time and date for the event.

"The free speech area is available without reservation, especially to accommodate impromptu activities," said Kenneth Davidson, associate vice president and general counsel of legal services. "The free speech area within the commons is not intended to be the exclusive area on campus where expressive activities are conducted."

Through successful coordination with the NIU Department of Public Safety, peaceful and organized marches, parades and picketing occur on campus grounds every year.

This policy is a component of the NIU Student Code of Conduct, and can be viewed online at http://www.stuaff.niu.edu/judicial/demnsrt.htm.
