Motion requests judge to dismiss student charges

A motion to dimiss the charge of resisting a peace officer will be reviewed at a hearing today for about 75 NIU students involved in the Day of Action II sit-in protest on Lincoln Highway April 13.

Don Henderson, NIU director of Students’ Legal Assistance and defense attorney for 65 of the students, said the students filed for dismissal of the charge because they questioned the nature of the charge.

Defense attorneys for the students said they do not believe the charge accurately desribes the action of the demonstrators at the sit-in.

At the demonstration, students were asked by police to leave the highway but refused to do so. After about 90 minutes, students were transported by police to the DeKalb Police Station.

Students were originally charged with mob action, but this violation was dropped at a June 14 review hearing. At this time, a charge of resisting a peace officer was added.

In addition, the students were charged with obstruction of a state highway.

The hearing will be at the DeKalb Municipal Building, 200 S. Fourth St., at 10:30 a.m.
