Status review hearing for Day of Action charges postponed

Friday’s status review hearing for about 75 NIU students who were charged with resisting a peace officer and obstructing a highway has been postponed until Sept. 30.

Don Henderson, NIU director of Students’ Legal Assistance and defense attorney for 65 of the students, said the hearing was continued because DeKalb Circuit Court Judge Douglas Engel was unavailable Friday.

The students are motioning for dismissal of the resisting a peace officer charge.

Originally they were charged with mob action and obstruction of a highway after the Day of Action II sit-in on Lincoln Highway April 13.

However, the mob action charge was dropped at a status review hearing June 14, and the resisting a peace officer charge was added.

Demonstrators filed the motion because they questioned the nature of the resisting a peace officer charge, Henderson said.
